INGKA CENTRES WIFI – WIRELESS INTERNET CONNECTION AT INGKA CENTRES’ VENUES

Dear Visitor, welcome to the Ingka Centres Management UK Ltd, with its registered office at 100 Avebury Boulevard, Milton Keynes, United Kingdom, MK9 1FH (“Ingka Centres”) venue!

By activating or using the Wi-Fi network communications services and related services and features (the “Service”) provided by Ingka Centres at the venue, you agree to be bound by these Terms and Conditions of Use (this “Agreement”) including the Privacy Notice.

Please read these Terms and Conditions carefully. They affect your legal rights by, among other things, limiting our liability. If you do not agree to this Agreement, do not activate or use the Service. These Terms and Conditions may be revised periodically, and we advise you to check the Terms and Conditions from time-to-time for any changes. Any continued use of the Service by you after any changes have been made shall be deemed as your consent to such changes.

1. Terms and Conditions of Use

1.1 The Service is intended for consumer use only.
1.2 The Service cannot be used in a way that violates applicable law, conflicts with good practice or harms Ingka Centres, the Ingka Centres group or the Ingka Group.
1.3 As a user, you must not use the Service to access internet services, or send or receive e-mails, namely but not limited to:

(i) which are defamatory, threatening, intimidatory or which could be classed as harassment;
(ii) that contain obscene, profane or abusive language or material;
(iii) that contain pornographic material;
(iv) that contain offensive or derogatory images regarding gender, race, religion, origin, age, physical or mental disability, medical condition or sexual orientation;
(v) that contain material which infringe a third party’s rights (including intellectual property rights); or
(vi) that are otherwise unlawful or inappropriate.
1.4 The Service is subject to unavailability, including emergencies, third-party service failures, transmission, equipment or network problems or limitations, interference, signal strength, and maintenance and repair. The Service may be interrupted, refused, limited or curtailed by Ingka Centres at any time and for any or no reason.
1.5 Ingka Centres is not responsible for data, messages or pages lost, not delivered, delayed or misdirected because of interruptions or performance issues with the Service or communications services or networks or damage to your device from using the Service.
1.6 You are responsible for obtaining, maintaining and setting up your own equipment and hardware in order to access and use the Service and you take responsibility for the protection of your equipment through the use of up to date virus protection, personal firewalls and any other suitable measures you deem necessary.
1.7 Ingka Centres may suspend the Service or block certain kinds of usage to protect users, its network and its organisation without notice at any time at its discretion.
1.8 Ingka Centres reserves the right to filter out websites containing content that could be considered to be offensive, illegal or pornographic. Ingka Centres may also terminate or temporarily suspend, withdraw or discontinue your access to the Service without notice if it reasonably believes that you are in breach of any provisions of these Terms and Conditions. You agree to indemnify Ingka Centres and its partners, directors and employees against any and all losses suffered by Ingka Centres, as a result of your use of this service in breach of these Terms.
1.9 Please note that Ingka Centres does not control, nor is it responsible or liable for, data, content, services, or products (including software) that you access, download, receive or buy when using the Service. How third parties handle and use your personal information related to their sites and services is governed by their security, privacy and other policies (if any). Ingka Centres has no responsibility for any third-party provider’s policies, or their compliance with them.
1.10 As a user you are recommended to further secure sensitive information by using encrypted websites such as “https”. Ingka Centres recommends that you do not handle sensitive or confidential information when using the Service. Should you choose to do so, you do so at your own risk. The main responsibility for security lies, as with all internet traffic, with you as a user.

2. Warranties

2.1 Ingka Centres is providing this service to you "as is" without warranty of any kind. You assume the risk of any and all damage or loss from the use of, or the inability to use, the service.
2.2 To the maximum extent permitted by law, Ingka Centres expressly excludes any and all warranties, express or implied, regarding the service and Ingka Centres’ performance of this agreement, including but not limited to, any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Ingka Centres does not warrant that the service will meet your requirements or that the operation of the service will be uninterrupted or error free.

3. Liability

3.1 To the maximum extent permitted by law, in no event will Ingka Centres be liable for damages of any kind (including but not limited to, special, incidental or consequential damages, lost profits or lost data, regardless of the foreseeability of those damages) arising out of or in connection with your use of the service or any other material or services provided to you by Ingka Centres.
3.2 The limitation will apply regardless of whether the damages arise out of breach of contract, tort, or any other legal form of action. Without limiting the foregoing, in no event will Ingka Centres’ aggregate liability to you relating to or arising out of this agreement, whether in contract, tort or otherwise, exceed the total amount, if any, paid by you to Ingka Centres for your use of the service as set out herein.

4. Governing law

4.1 These Terms and all matters arising from or in connection with them shall be governed by and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England and Wales.
